Federal eviction moratoriums ruled unconstitutional by Texas judge

Yesterday, a Texas judge ruled that federal moratoriums on evictions are unconstitutional, stating "Although the COVID-19 pandemic persists, so does the Constitution." The decision points out that there are other remedies available to tenants under state and local law, but issues a declaratory judgment that the CDC does not have the power under the commerce clause to issue a federal moratorium on evictions, noting that the federal government has never before claimed to have such far-reaching power over property rights that are governed by state law.
